By accessing or using Truuly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Truuly is a Software-as-a-Service (SaaS) platform that uses advanced natural language processing technology to transform AI-generated text into human-sounding prose. The Service is provided on a subscription basis and includes access to our web application, API, and related features as described in your selected plan.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
Subscription Plans: The Service is offered through various subscription plans with different features and usage limits. Details of available plans and pricing are available on our website.
Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). You authorize us to charge your payment method on file for all applicable fees.
Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.
Price Changes: We reserve the right to modify subscription prices at any time. Price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle.
You agree to use the Service only for lawful purposes and in accordance with these Terms. Prohibited uses include:
Service Ownership: The Service, including all software, algorithms, text, graphics, logos, and other content (excluding User Content), is owned by Truuly and is protected by copyright, trademark, and other intellectual property laws.
User Content: You retain all ownership rights to the content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, worldwide, non-exclusive license to process, store, and transform your content solely to provide the Service to you.
Output Content: Content generated by the Service based on your User Content ("Output Content") belongs to you. We do not claim ownership of Output Content and will not use it for any purpose other than providing the Service to you, except as required by law.
We implement a zero-retention policy for processed content. User Content and Output Content are permanently deleted from our servers within 24 hours after processing, except as required for backup and security purposes or as required by law. We never use your content to train our models or share it with third parties.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUULY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee that Output Content will pass all AI detection tools or meet any specific quality standards.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if they qualify.
